THE BUYER:

1) The BUYER shall NEVER surrender the cat/kitten to a pet shop, humane society, animal shelter or any other place of similar characteristics. Neither shall the BUYER surrender the cat to be studied for scientific or research purposes.

2) The BUYER shall not exhibit the cat/kitten at Cat Shows without the authorization of the BREEDER (see marked box above).

3) The BUYER shall maintain the cat/kitten in optimum conditions, providing all required for the physical and psychological well being of the cat/kitten.

4) The BUYER shall, immediately and without delay, take the cat/kitten to the veterinarian whenever there are any signs of illness, disease, discomfort or any other unusual symptoms.

5) The BUYER expressly states herein that the cat/kitten shall be INDOOR only.

6) The BUYER expressly states that they shall NOT declaw the cat/kitten. Doing so shall invalidate all health guarantees contained herein and imply a penalty of $250.00.

7) The BUYER expressly states that they shall follow the vaccination recommendations of the American Association of Feline Practitioners and NOT administrate the FIV or FIP vaccine to the cat/kitten. Doing so shall invalidate all health guarantees contained herein.

8) The BUYER shall always maintain the BREEDER informed of the whereabouts of the cat/kitten and shall notify the BREEDER of any change of address, telephone number, etc.

9) Should the BUYER place the cat/kitten with a third party (hereinafter NEW OWNER) in the future, the BUYER shall make every effort to assure the well being of the cat and suitability of the new home. The BUYER shall inform the BREEDER of said new ownership, forwarding any and all contact information on the NEW OWNER to the BREEDER, and shall make the NEW OWNER aware of this Agreement. All terms and conditions of this Agreement shall be transferred to the NEW OWNER, who shall be fully responsible and accept compliance with the same. Should this cat be a breeding cat, the BUYER shall inform the BREEDER of transfer of ownership and/or leasing and shall obtain the written permission of the BREEDER before proceeding with the transaction. In no case shall the BUYER re-sell the cat/kitten considered herein.

10) The BUYER shall notify the BREEDER of any future health problem that could be hereditary or genetic. (see Section 2, point 6).

11) Should the BUYER fail to comply with any of the terms and conditions of this Agreement, the BREEDER has the right to reclaim the cat/kitten and any offspring born in breach of this agreement at any time and with no compensation to the BUYER.

12) The BUYER shall allow 3 follow-up calls/visits/e-mails within the first 3 months following adoption, and occasional calls/visits/e-mails thereafter to verify the well-being of the cat/kitten.
a) In the case of shipping, and in addition to the above, the BUYER shall be available to receive a call from the BREEDER or shall call the BREEDER the day prior to shipping to confirm receipt of the cat the following day and, upon receipt of the cat, the BUYER shall notify the BREEDER, by telephone, of the safe arrival or delay of the same within 2 hours following the scheduled flight arrival time.

THE BREEDER:

1. The BREEDER shall deliver the cat/kitten in optimum conditions of health, with pertinent vaccinations.

2. To ensure health of the cat upon purchase:
¨ The BUYER shall take the cat to their veterinarian within 5 days (preferably within 48 hours) following receipt of the cat/kitten. The BUYER shall immediately inform the BREEDER of the results of said examination. Should any health problems be found at this examination, the BREEDER shall be liable for veterinary costs up to but not exceeding one-half the purchase price. Should the BUYER fail to take the cat to the veterinarian within this period and duly inform the BREEDER in writing of the results of the same within one week following date of purchase, the BUYER shall be exonerated of all health commitments herein, or
¨ The BREEDER shall provide a Veterinary Certificate of Health issued within 10 days prior to the date of sale.

3. The BREEDER shall notify the BUYER, at the end of this Agreement (Annex, point 2), of any possible illness, health problem or behavioral disorder the cat/kitten does or could suffer. The BUYER understands, accepts and is fully liable for any future problems inherent to the condition and exonerates the BREEDER from the same. As the BREEDER can not know the future care or conditions the BUYER will provide to the cat/kitten, the BREEDER shall not be liable for any illness, health problem or behavioral disorder that could occur in the future, with the exception of financial compensation in the case of Point 6 below.

4. The BREEDER shall be exonerated from all liability in the unlikely event of injury or illness to the BUYER, their animals or any other third party (person or animal), at any time after purchase, caused by the cat/kitten considered herein.

5. The BREEDER shall accept the return of the cat/kitten for a period of 7 days following the date of purchase for dissatisfaction on any kind. In this case only, the BREEDER shall return the full purchase price. If shipping is required at any time for the return of a cat to the BREEDER, shipping costs shall be equally divided between the BREEDER and the BUYER.

6. The BREEDER shall return up to one-half the purchase price of the cat/kitten should the animal develop a serious GENETIC illness/problem during the first two years of the cat's life. The consideration of GENETIC shall be subject to the evaluation of the BREEDER's veterinarian, the BUYER's veterinarian and, if required, a third veterinarian unrelated to either party. In no case shall the BREEDER be liable or financially responsible for veterinary or any other expenses exceeding one-half the purchase price of the cat/kitten, and said responsibility shall be limited solely to GENETIC (inheritable) problems. NOTE: This clause is NOT applicable for Feline Infectious Peritonitis.

7. In no other case except for 5 and 6 above shall the BREEDER return the total or partial price of the cat/kitten. Nevertheless, should there be a genetic illness/problem, the BREEDER has the option to offer a new cat/kitten to the BUYER instead of the purchase price, if the BUYER so wishes. In all cases the final decision to offer a cat/kitten instead of the purchase price of the original cat/kitten shall always be to the discretion of the BREEDER.

8. The BREEDER will ALWAYS accept the return of the cat should the BUYER not be able to keep the animal or find a suitable NEW OWNER if the need arises. Nevertheless, in this case the BUYER has no right to any compensation from the BREEDER.

9. If the cat/kitten is for showing, the BREEDER does not guarantee the temperament or success of the animal in the show hall.

1. Any legal issues arising from this contract shall be subject to the local courts of the BREEDER.

2. Any attorney's fees or court fees arising from breach of this contract shall be to the account of the individual with whom the cat has been placed.

3. The signing of this agreement by the BUYER and the BREEDER and the receipt of the cat/kitten implied herein shall imply legal transfer of ownership of the same.

Point 1

Neutered pet:
- Registration papers, pedigree and vaccination/health information shall be provided upon purchase.

Show Alter:
- Vaccination/health information, pedigree and registration papers shall be provided upon purchase.
- BUYER shall maintain the BREEDER advised of the show progress of the cat.

Breeding/Show cat:
- Vaccination/health information, pedigree and registration papers shall be provided upon purchase.
- Compensation for this animal shall be (choose one):

¨ Kitten back only
¨ Purchase price plus kitten back from breeding of this cat
¨ Purchase price plus kitten back from breeding of other cats
¨ Other (see Annex)
- After receiving BREEDER approval, the BUYER shall breed this cat only to other American Curls or Domestic Outcrosses. Under NO circumstance shall the BUYER breed this cat to any breed other than the aforementioned.
- If a Show Cat, the BUYER shall maintain the BREEDER advised of the show progress of the cat.

This Agreement, consisting of three pages, is signed in duplicate, one copy for the BUYER and the other for the BREEDER, on the date of _____________________ . If an electronic copy, both parties recognize the electronic copy as an original.
